Please read these Terms and Conditions ("Terms", "Agreement") carefully before using Qvik.World (the "Service", "App") operated by Story Prediction Pvt Ltd ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Definitions

  • "Service" refers to the Qvik.World AI chatbot application and all associated features
  • "User", "You" refers to the individual or entity accessing or using our Service
  • "Content" means text, images, data, information, or other materials submitted, posted, or transmitted through the Service
  • "AI Output" refers to responses, text, or other content generated by our artificial intelligence system
  • "Account" means the unique account created for you to access our Service
  • "Agent Development Services" refers to custom engagements under which we design, build, and deliver agents to your requirements, as described in Section 11

2. Acceptance of Terms

By clicking "Sign Up", "Create Account", "I Accept", or by accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. This Agreement is effective as of the date you first access or use the Service.

3. Eligibility and Account Registration

3.1 Minimum Age

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Service
  • If you are between 13 and 18 years old, you may only use the Service with the permission and supervision of a parent or legal guardian who agrees to be bound by these Terms
  • Users under 13 are not permitted to use the Service

3.2 Account Creation

  • You must provide accurate, complete, and current information during the registration process
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are fully responsible for all activities that occur under your account
  • You may not share your account with others or allow others to access your account
  • You must notify us immediately of any unauthorized use of your account

3.3 Account Suspension or Termination

  • We reserve the right to suspend or terminate your account at any time if you violate these Terms
  • You may terminate your account at any time by following the instructions in your account settings

4. Description of Service

Qvik.World is an AI-powered chatbot service that uses machine learning and natural language processing to provide automated conversational responses. The Service may include:

  • Text-based chat interactions
  • AI-generated responses and content
  • Access to various AI models and features
  • File upload and analysis capabilities (if applicable)
  • Custom agent development services, where our team designs and builds agents to your requirements ("Agent Development Services")

5. Acceptable Use Policy

5.1 Permitted Uses

You may use the Service for lawful purposes in accordance with these Terms, including:

  • Personal assistance and information gathering
  • Educational purposes
  • Content creation and brainstorming
  • Professional productivity tasks

5.2 Prohibited Uses

You agree NOT to use the Service for any of the following purposes:

Illegal Activities:

  • Any illegal, harmful, fraudulent, or abusive activity
  • Violating any applicable local, state, national, or international law
  • Activities that exploit, harm, or attempt to exploit or harm minors
  • Stalking, harassing, or threatening others

Harmful Content:

  • Creating, uploading, or transmitting content that is defamatory, obscene, pornographic, hateful, discriminatory, or violent
  • Generating content that promotes racism, bigotry, hatred, violence, or discrimination against individuals or groups
  • Creating content that incites terrorism, extremism, or criminal activity
  • Developing or distributing malware, viruses, or harmful code

Misuse of Technology:

  • Attempting to reverse engineer, decompile, or discover the source code of our Service
  • Bypassing or circumventing security measures or access controls
  • Using automated systems (bots, scrapers) to access the Service without permission
  • Overloading, interfering with, or disrupting the Service or servers
  • Attempting to gain unauthorized access to any part of the Service

Intellectual Property Violations:

  • Infringing on the intellectual property rights of others
  • Using the Service to generate content that violates copyrights, trademarks, or other proprietary rights

Misrepresentation:

  • Impersonating any person or entity
  • Misrepresenting your affiliation with any person or entity
  • Providing false or misleading information

Professional Services (Without Qualification):

  • Providing medical diagnoses or treatment advice
  • Offering legal advice or practicing law without authorization
  • Giving financial advice without proper licensing
  • Making decisions with legal or similarly significant effects without human oversight

Academic Dishonesty:

  • Using the Service to complete assignments or exams in violation of academic integrity policies (users are responsible for complying with their institution's policies)

6. AI-Generated Content and Limitations

6.1 Nature of AI Output

  • Our Service uses artificial intelligence and machine learning to generate responses
  • AI Output is probabilistic and may not always be accurate, complete, reliable, or appropriate
  • AI systems can make mistakes, produce biased content, or generate incorrect information
  • The Service is constantly being improved, but accuracy cannot be guaranteed

6.2 No Professional Advice

  • The Service does NOT provide professional advice (legal, medical, financial, etc.)
  • AI Output should not be relied upon as a substitute for professional consultation
  • You should verify all AI Output before taking action or making decisions based on it
  • We are not liable for any decisions you make based on AI Output

6.3 User Responsibility

  • You are solely responsible for evaluating the accuracy and appropriateness of AI Output
  • You must use your own judgment when relying on information from the Service
  • You should cross-reference important information with authoritative sources

7. User Content and Data

7.1 Your Content

  • You retain ownership of any Content you submit to the Service
  • By submitting Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your Content solely to provide and improve the Service
  • You represent that you have all necessary rights to the Content you submit

7.2 Our Use of Content

  • We may use your Content to:
  • Provide, maintain, and improve the Service
  • Train and improve our AI models (you may opt out as described in our Privacy Policy)
  • Comply with legal obligations
  • Enforce our Terms and policies
  • Ensure safety and security of the Service

7.3 Content Standards

  • You are responsible for all Content you submit
  • You must not submit Content that violates these Terms or applicable laws
  • We reserve the right to remove any Content that violates these Terms

7.4 Prohibited Content

You may not submit Content that:

  • Contains personal health information, financial account numbers, passwords, or other sensitive data
  • Violates privacy rights or confidential information of others
  • Contains malicious code or links to harmful sites
  • Infringes intellectual property rights

8. Intellectual Property Rights

8.1 Our Intellectual Property

  • The Service, including all software, algorithms, models, design, text, graphics, logos, and other materials, is owned by us or our licensors
  • All intellectual property rights in the Service are reserved
  • These Terms do not grant you any rights to our trademarks, service marks, or logos

8.2 License to Use Service

  • Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes
  • You may not sell, rent, lease, sublicense, distribute, or otherwise transfer your rights to use the Service

8.3 AI Output Ownership

  • Subject to your compliance with these Terms and our policies, you own the AI Output generated through your use of the Service
  • However, due to the nature of AI, similar or identical output may be generated for other users
  • We make no claims to ownership of AI Output, but we are not liable if identical output is generated for multiple users

9. Third-Party Services and Links

  • The Service may contain links to third-party websites, applications, or services that are not owned or controlled by us
  • We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services
  • You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party services
  • We recommend reviewing the terms and privacy policies of any third-party services you access

10. Subscriptions and Payments

10.1 Subscription Plans

  • The Service may be offered on a subscription basis with various plans and pricing tiers
  • Subscription fees are charged in advance on a recurring basis (monthly, annually, etc.)
  • All fees are in U.S. dollars unless otherwise stated

10.2 Billing

  • You authorize us to charge your chosen payment method for all fees
  • You are responsible for providing accurate and current billing information
  • Payment is processed through secure third-party payment processors (e.g., Stripe, PayPal)
  • We do not store your complete credit card information

10.3 Automatic Renewal

  • Subscriptions automatically renew at the end of each billing period unless cancelled
  • You will be charged for the renewal within 24 hours before the end of the current period
  • You may cancel automatic renewal at any time through your account settings

10.4 Changes to Pricing

  • We reserve the right to modify our pricing at any time
  • We will provide you with reasonable advance notice of any price changes
  • Price changes will apply to your next billing period after the notice
  • If you do not agree with the price change, you may cancel your subscription before it takes effect

10.5 Refunds

  • Refunds are governed by our Cancellation and Refund Policy
  • Please refer to our separate Refund Policy document for detailed information
  • Refunds for Agent Development Services are governed by Section 3 of the Cancellation and Refund Policy

10.6 Free Trials

  • We may offer free trial periods for new users
  • At the end of the trial period, you will be automatically charged unless you cancel before the trial ends
  • We reserve the right to modify or terminate free trial offers at any time

11. Agent Development Services

11.1 Engagements

We may offer Agent Development Services under which our team designs, builds, and delivers agents to your requirements. The scope, fees, timelines, and deliverables of each engagement will be set out in a written proposal, order form, or statement of work agreed between you and us. In the event of any conflict between such a written agreement and these Terms, the written agreement prevails for that engagement.

11.2 Your Inputs

You are responsible for the accuracy and completeness of the requirements, data, documents, and other materials you provide for an engagement, and you represent that you have all rights necessary to share them with us for this purpose.

11.3 Delivery and Acceptance

Deliverables are provided electronically through the Service. A deliverable is deemed accepted when you confirm acceptance or when seven (7) days have passed from delivery without a written objection, whichever occurs first.

11.4 Ownership of Deliverables

Subject to full payment of the applicable fees, you own the agent configurations and deliverables created specifically for you under an engagement. Our underlying platform, software, models, engine, and all pre-existing intellectual property remain our exclusive property and are licensed to you only to the extent necessary to use your agents within the Service.

11.5 Third-Party Provider Keys

Agents may operate using API keys for third-party AI providers that you connect to your account. Your use of those providers is governed by your own agreements with them, and you are responsible for all charges billed by those providers.

11.6 Fees and Cancellation

Fees for Agent Development Services are as agreed for each engagement. Cancellation and refunds for engagements are governed by the Cancellation and Refund Policy.

12. Privacy and Data Protection

  • Your privacy is important to us
  • Our collection and use of personal information is described in our Privacy Policy
  • By using the Service, you consent to our collection and use of information as described in the Privacy Policy
  • We implement appropriate security measures to protect your data
  • However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED
  • WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of Content or AI Output
  • Uninterrupted or error-free operation
  • Security or absence of viruses or other harmful components
  • WE DO NOT WARRANT THAT:
  • The Service will meet your requirements
  • The Service will be available at any particular time or location
  • Any defects or errors will be corrected
  • The results from using the Service will be accurate or reliable
  • YOU USE THE SERVICE AT YOUR OWN RISK

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • IN NO EVENT SHALL WE, OUR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY:
  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR USE
  • BUSINESS INTERRUPTION
  • COST OF SUBSTITUTE SERVICES
  • ARISING OUT OF OR RELATING TO:
  • Your use or inability to use the Service
  • Any AI Output or Content
  • Unauthorized access to or alteration of your data
  • Any other matter relating to the Service
  • WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
  • OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER
  • SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU

15. Indemnification

You agree to indemnify, defend, and hold harmless Story Prediction Pvt Ltd, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your Content or any Content submitted through your account
  • Your violation of any applicable laws or regulations

16. Modifications to the Service and Terms

16.1 Changes to Service

  • We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice
  • We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service
  • If we discontinue the Service, we will provide reasonable advance notice

16.2 Changes to Terms

  • We may update these Terms from time to time
  • We will notify you of material changes by:
  • Posting the updated Terms on the Service
  • Sending an email notification to your registered email address
  • Displaying a prominent notice in the Service
  • The "Last Updated" date at the top will be revised
  • Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms
  • If you do not agree to the updated Terms, you must stop using the Service

17. Termination

17.1 Termination by You

  • You may terminate your account at any time through your account settings or by contacting us
  • Upon termination, your right to use the Service will immediately cease

17.2 Termination by Us

  • We may suspend or terminate your account immediately, without prior notice or liability, if:
  • You breach these Terms
  • You engage in fraudulent or illegal activity
  • Your use of the Service poses a risk or harm to us, other users, or third parties
  • We are required to do so by law
  • Your account has been inactive for over one year (for free accounts)
  • We will provide advance notice when reasonably possible

17.3 Effects of Termination

  • Upon termination:
  • Your right to use the Service will immediately cease
  • We may delete your account and Content
  • You remain liable for all charges incurred prior to termination
  • Sections of these Terms that by their nature should survive will remain in effect

17.4 Appeals

  • If you believe your account was terminated in error, you may contact us at [email protected] to appeal

18. Chargebacks and Disputes

  • If you initiate a chargeback or payment dispute, we may immediately suspend or terminate your account
  • We reserve the right to contest any chargeback by providing evidence that the charge was authorized
  • Chargebacks are considered a breach of your payment obligations under these Terms
  • You agree to work with us directly to resolve any billing disputes before initiating a chargeback

19. Export Control and Sanctions

  • The Service may be subject to export control laws and regulations
  • You represent that you are not located in a country subject to U.S. or other applicable government embargo
  • You are not identified on any government list of prohibited or restricted parties
  • You will comply with all applicable export control and sanctions laws

20. Governing Law and Dispute Resolution

20.1 Governing Law

  • These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions

20.2 Dispute Resolution

  • Any dispute arising out of or relating to these Terms or the Service shall be resolved through:
  • Informal Negotiations: First, contact us at [email protected] to attempt to resolve the dispute informally
  • Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration in India under the rules of applicable arbitration rules in India
  • Class Action Waiver: You agree to resolve disputes on an individual basis only, and not as part of any class, consolidated, or representative action

20.3 Exceptions

  • Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access
  • Small claims court actions may be pursued if they qualify

21. Miscellaneous

21.1 Entire Agreement

  • These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and us regarding the Service

21.2 Severability

  • If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect

21.3 Waiver

  • Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision

21.4 Assignment

  • You may not assign or transfer these Terms or your rights hereunder without our prior written consent
  • We may assign our rights and obligations under these Terms without restriction

21.5 No Agency

  • Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship

21.6 Force Majeure

  • We shall not be liable for any failure to perform due to causes beyond our reasonable control

21.7 Notices

  • Notices to you may be sent to your registered email address or posted on the Service
  • Notices to us should be sent to [email protected]

21.8 Language

  • These Terms may be translated into other languages. In case of conflict, the English version shall prevail
